COPYRIGHT & LICENCE TO USE
The entire copyright and all similar rights throughout the world in the photographs created by or for the Photographer shall vest in and be retained by the Photographer at all times.
The Licence to use images only applies to the Client(s) as agreed at time of order:
Permission is needed for magazines and print. All images to be credited to the photographer. The Licence to Use comes into effect from the date of payment of the relevant invoice(s). No use may be made of the photographs before payment in full of the relevant invoice(s) without the Photographer's express permission.
CONDUCT OF SHOOT
The shoot will be arranged on date(s) mutually agreed between the Parties.
During the shoot the Photographer will take account of the Client’s reasonable instructions in respect of the shoot brief.
If the Client is not present during the shoot then the Photographer’s interpretation of the brief shall be deemed acceptable to Client.
The Client shall not be entitled to reject the Material on the basis of style or composition.
PAYMENT
Invoices must be paid within 30 days of the date of issue. The Photographer reserves the right to charge interest on late payments at the rate prescribed by the Late Payment of Commercial Debts (Interest) Act 1998 from the date payment was due until the date payment is made.
All expenses and production costs leading up to the shoot must be paid in advance of the shoot unless otherwise agreed in writing and such invoices are due on presentation.
Usage Licence and any third party fees negotiated by the Photographer are payable regardless of whether Licensed Images are in fact used by the Client or the Advertiser.
All payments are due in pounds sterling unless expressly stated otherwise.
RELEASES / AUTHORISED PERMISSION
The Client shall be responsible for obtaining any required clearances and will indemnify the Photographer against all expenses, damages, claims and legal costs arising out of any failure to obtain such clearances. Unless delivered to Client by Photographer, no model or property release exists, and it is Client's responsibility to obtain the necessary permissions for usages that require any model or property releases not delivered by Photographer.
CANCELLATION / RESCHEDULING
A booking is considered firm as from the date of confirmation.
STORAGE
Images are stored by the photographer for 18 months.
LIABILITY
Client assumes full risk of any loss or damage to or arising from materials and warrants that said materials are adequately insured against such loss, damage, or liability.
